2014/01/11 Weapon Control Bill

Commoner Wells hat folgenden Entwurf eingebracht. Die Aussprachedauer beträgt zunächst 96 Stunden.


Weapon Control Bill

Article I des Astoria State Weapon Control Act wird wie folgt neu gefasst:

    Dieses Gesetz regelt den Besitz, das Führen und die Nutzung von Waffen in Astoria State. Das Besitzen, Führen und Nutzen von Waffen ist in Astoria State grundsätzlich erlaubt, Ausnahmen sind ausschließlich durch ein Gesetz oder aufgrund eines Gesetzes möglich.


Article VII des Astoria State Weapon Control Act wird wie folgt ergänzt:

    (5) Für das Besitzen, Tragen und Führen von Waffen im Sinne von Article II, Sec. 1 bis 4 gilt eine Altersuntergrenze von 18 Jahren.

anders als der letzte Entwurf verzichtet dieser Entwurf auf eine umständliche Definition, was nun eine Defensivwaffe ist. Im Gegenteil wird der Waffenbesitz einfach generell soweit freigegeben, wie ihn das entsprechende Gesetz nicht einschränkt - damit wird ein Formulierungsfehler aus dem bisherigen Gesetz behoben.

Auch ich begrüsse dieses Amendment grundsätzlich. Allerdings drängt sich mir zwei Fragen auf:
(5) Für das Besitzen, Tragen und Führen von Waffen im Sinne von Article II, Sec. 1 bis 4 gilt eine Altersuntergrenze von 18 Jahren.
bedeutet dies dass das Nutzen von Waffen etwa innerhalb eines Schiessstandes auch jüngeren Personen erlaubt wird? Und worin sieht der Antragssteller den Unterschied zwischen "Tragen" und "Führen"?

Die Intention dieses Antrages ist begrüssenswert. Allerdings tut sich auch bei mir im von Commoner Nagy zitierten Absatz das eine oder andere Fragezeichen auf.

Getragen wird etwa eine Pistole ohne Munition, geführt mit - ganz grob zusammengefasst. Eine umfassendere Definition bietet bestimmt ein Wörterbuch.
Für den Gesetzgeber ist es indes unerheblich, wer nun am Schießstand einen Schuss abgibt - ich vertraue hier auch auf das Verantwortungsbewusstsein der Verantwortlichen.

Die Unterscheidung zwischen Tragen und Führen scheint mir wenig sinnig, dennoch werde ich den Entwurf nicht ablehnen, da er ein Schritt in die richtige Richtung ist.
